Introduction

Modern trust deeds can be challenging to draft. They are increasingly bespoke depending on the context in which the trust is being settled, and the assets the trust is intended to hold.

This webinar will focus on common drafting issues, particularly in the following contexts:

• trusts established for asset planning in the blended family context;
• trusts established primarily for asset protection or relationship property purposes;
• trusts settled during an existing relationship which contemplate what will take place on separation;
• trusts which are expected to hold commercial or farming assets (where there may be greater risks for professional trustees).

It will also address key matters for advisors to be aware of in light of the Trusts Act 2019 including key modifications to default duties, dealing with the provision of trust information, and how advisors can comply with their obligations (and avoid the risks associated with failing to do so). It will also address other drafting matters.
