Guarantees continue to be the subject of considerable litigation. Much of the litigation is concerned with the scope of the solicitor’s role when advising prospective guarantors. When a guarantor seeks to avoid liability, the part played by the advising solicitor will often come under scrutiny. In this seminar we look at four aspects of the law relating to guarantees:

  • the lessons to be learned from the recent House of Lords’ decision in Etridge;
