Introduction

The Whakaari prosecutions have dominated the health and safety space this year, being the most high profile health and safety prosecutions since the Pike River Mine disaster. The Whakaari litigation serves as an important reminder to employers to be vigilant in ensuring that workplace risks are properly managed.

There have also been a number of significant decisions on applications to dismiss charges, the nature of a person conducting a business or undertaking (PCBU), court ordered enforceable undertakings, director’s health and safety duties and a great deal of liability and sentencing decisions.

The Government has also announced its plans for significant employment law reform this year.
