Background
Franchising is developing in New Zealand at a very fast rate. Some people may wonder exactly what franchising is and it is also fair to say that some people use the term loosely and in the wrong context. Quite simply, franchising is a method of marketing goods and services. It has evolved out of a number of business transactions, methods and practices which had been common and popularly known for many years. As a legal and marketing concept it is not new.
Purpose and scope of paper
The purpose of this paper is not to cover every aspect of franchising superficially but to give a clear understanding of what it is and to cover some areas in reasonable detail. The oral seminar presentation will seek to highlight important and relevant commercial and legal aspects of franchising and their relationship. The seminar will also include a Case Study with the three speakers playing the roles of franchisor, franchisee and landlord in an attempt to explain key aspects of franchising.
