This seminar aims to do two things. First, to update and revise the “Education Law” seminar presented by Paul Rishworth and Patrick Walsh for the NZLS in 1999. Updating and revising is necessary because there have been significant legislative changes in key areas, employment law and school enrolment schemes. There have been case-law developments in these and other areas as well. Further, the pending Education Amendment Bill will introduce significant changes, especially in the area of professional discipline for teachers.

The second aim is to cover some important areas that were not dealt with in the 1999 seminar, or to deal with them more fully. These are:
  • the Privacy Act 1993 in schools;
  • issues surrounding teacher registration and the proposed disciplinary regime under the pending Education Amendment Bill;
  • extent of school power and authority over students off school premises and after hours; and
  • what we describe as a “pot pourri” of recurring legal issues in schools on a variety of topics.

In order to maximise the utility of this seminar booklet, we have summarised the relevant material from the 1999 booklet as well as adding updates or further topics. In that way this present booklet can be used as a free-standing resource.

In 1999 the seminar was called “Education Law”. This one is called “School Law” in recognition that it addresses legal problems commonly arising in primary and secondary education. It does not specifically address the tertiary and early childhood sectors.
