Introduction

This seminar booklet was first prepared to accompany a seminar presented in February 2023.

While much of the general content still applies, a key update is that Standards New Zealand has now published NZS 3910:2023 conditions of contract for building and civil engineering construction, superseding NZS 3910:2013. There are several changes to the provisions relating to time for completion, some of which are discussed where applicable below (without being a complete commentary on the changes). Some of the changes tend to emphasise the need for lawyers and clients to have a good understanding of wider concepts relating to delay analysis, as discussed later.

We have nevertheless retained some references to NZS 3910:2013 in recognition of the fact that there may be a lead time before some parties adopt NZS 3910:2023 (it is not unheard of to find some contracts still based on NZS 3910: 2003!).
