Introduction

This paper addresses a number of strata law ethical issues from the perspective of the law as it stands in New Zealand.

I commence this paper by referring to the relevant rules of professional conduct which govern the provision of legal services where there is, or is the potential for, a conflict of interest.

I follow this with a brief discussion of significant cases which have been decided in the New Zealand context which guide the response to the questions which are addressed later in this paper.

Thereafter I provide answers to a number of questions concerning ethical issues which can be expected to arise in strata legal matters from a New Zealand perspective.
