On Demand Module

Presentation time: 90 minutes

CPD HRS

Coronavirus and COVID-19 and the resulting national “lockdown” has resulted in significant distress for a very large number of businesses including both landlords and tenants. The New Zealand Government has, in response to the COVID-19 epidemic, issued notices under the Epidemic Preparedness Act 2006, the Heath Act 1956 and the Civil Defence Emergency Management Act 2002. What are the rights and obligations of landlord and tenant in this period? How do those notices, and the various directives under them, affect them?

This seminar will include:

  • What the state of emergency and lockdown rules mean for commercial leases
  • Is rent payable during "lockdown"?
  • "No access" provisions and related clauses, and how they work
  • Frustration and force majeure
  • Default and Property Law Act notices.

Please contact us if you use a dial up internet connection.

Learning objectives

After completing this module you will gain:

  • Greater knowledge on the operation of commercial leases during a national emergency such as COVID-19.
  • Practical advice on how to apply this knowledge to help you provide robust advice to your clients.

Introduction

1.1 This paper has been prepared under urgency to assist practitioners in addressing the issues which arise for commercial Landlords and Tenants out of the COVID-19 pandemic and the Government response to it – in particular, the key measures of the lockdown.

1.2 It is obviously an evolving situation and so this paper is necessarily brief, and as much as anything is intended to act as a resource kit for practitioners advising their clients on these issues.

1.3 Schedules to this paper include extracts from standard form leases and copies of relevant orders and notices issued by the Government. URL references are also provided, which are current at the time of preparation of this paper, but which may
change.
