This module will look at areas of the Criminal Proceeds (Recovery) Act 2009 (the Act) regime that are of particular relevance to civil and regulatory practitioners. This presentation builds on a well-received session first presented at the Regulatory Investigations – a defence perspective forum held in March 2023.

Topics covered will include:

  • The investigative powers held by Police and the Official Assignee under the Act
  • The ongoing extension of the regime to “regulatory offending”
  • The interplay of civil and criminal proceedings relating to the same criminal activity
  • Compulsory examination orders
  • Tactics to diminish risk
  • Recent relevant case law
  • Recent amendments to the Act.

Learning objectives

By completing this module you will:

  • Develop understanding of the Criminal Proceeds (Recovery) Act 2009 regime.
  • Be better able to advise clients about their options and risks.
  • Learn about recent developments (including legislative amendments and tension between recent judgments).
