Building on a session at the Auckland CPD Day in February this year, this webinar will consider the key practical tax issues currently facing lawyers, including new tax rules introduced in response to the COVID-19 pandemic, and following the change of Government. It will also summarise current AML/CFT issues, look at the lessons learnt from the independent audit cycle, and provide an analysis of the Exemption Regulations.

This webinar will include:

  • Two of the important specialist subjects often needed by practitioners – Tax and AML/CFT.
  • Discussion on, the pace of change in New Zealand’s income tax and GST regimes is enormous. There are many changes (some as a response to COVID) which practitioners need to be aware of, including purchase price allocations, tax loss carry forward rules and employee share schemes, which frequently arise in practice.
  • AML/CFT issues, which continue to be of immense importance to practitioners in their day-to-day interactions with clients. This webinar will update practitioners in relation to current issues, including exemption regulations and lessons learnt from the recent independent audit cycle.
  • An overall presentation, that will keep practitioners up to speed in these two specialist areas, for the benefit of practitioners, their law firms, and their clients.

Introduction

This paper summarises current tax issues in New Zealand, with a focus on aspects of the policy response of the Government, Inland Revenue and Treasury to the impact of the COVID-19 pandemic in New Zealand.

As readers will be well aware, the pandemic is far from over, and the economic impact for New Zealand in the current year, and in future years, is uncertain. What is known is that the direct and indirect effects of COVID-19 in terms of business disruption and job losses has been and continues with each lockdown to be enormous, and that the level of Government spending to cope with the immediate impact of the pandemic and to position the economy for recovery, are unprecedented. The need for a timely and effective response from key stakeholders, often in near-real-time, has also been unprecedented.

This paper considers some of the detail of the policy response, and also considers the way in which Inland Revenue, Chartered Accountants Australia & New Zealand (CA ANZ) and the Law Society (as well as other key stakeholders, including Treasury, the Ministry of Business, Innovation and Employment, and the Corporate Taxpayer Group) addressed the acute need to respond to the crisis. The paper also touches on how Inland Revenue, CA ANZ and the Law Society developed new ways of working to respond, and what that might mean in terms of the future – in terms of consultation, representation, and the generic tax policy process (GTPP). An earlier version of this paper was presented at the 2020 NZLS CLE Tax Conference.
