Presentation time: 60 minutes

Cell phones, selfies, social networking sites, “friends” and being an employee can be a problematic mix. An employee’s private life is often not so private especially when lived online.

“Out-of-work” conduct may be scrutinised by employers, whether that is pre, during or post-employment. It may be failing to disclose previous convictions or other behaviours outside of the workplace becoming public.

By looking at recent developments and core principles, Samantha and Tim will discuss how an employee’s out-of-work conduct can/does impact on their employment situation.

This module will cover:
  • Modern workplaces
  • Statutory considerations
  • Evidential aspects
  • Pre-employment conduct
  • Out of work conduct
  • Conduct discovered after employment ends
  • Health and safety aspects.
This module is based on the successful presentation at the 2014 NZLS CLE Employment Law Conference.
