The not-for-profit sector is alive and well in New Zealand. We have over 23,000 incorporated societies (and a similar number of trusts registered under the Charitable Trusts Act 1957), but their needs and the law applying to them are changing.

The exposure draft of the Incorporated Societies Bill has been released recently for consultation, and new health and safety and vulnerable children legislation applies.

This module will introduce what is proposed in a new Incorporated Societies Act, discuss the implications of new health and safety and vulnerable children legislation, and will include the key factors that you need to take into account when providing advice in this area of legal practice. In particular, Mark will cover:

  • The pending changes to the substantive law on incorporated societies
  • The new health and safety and vulnerable children legislation
  • The need for improved not-for-profit governance
  • The problems in defining a charity.

Learning objectives

After completing this module you will:
  • Have a greater understanding of some issues facing not-for profits.
  • Have an overview of the new and proposed legislation.
  • Be able to apply this in your practice.
