Following the implementation of the EU General Data Protection Regulation, there has been increasing scrutiny and proposed reform to privacy and data protection law throughout the world, including in New Zealand with the introduction of our new Privacy Bill. Are you up to date with what’s happening in the fast-changing world of data protection and privacy?

We now live in a world where data is often an organisation’s greatest or most valuable asset. But with the combination of increased consumer awareness and rapidly changing technology, this often presents complex security, privacy and legal implications for businesses. Lawyers in virtually all practice areas must have some understanding of data security and privacy to ensure they can effectively assist their clients in managing this new and rapidly evolving regulatory landscape.

This module is an introductory overview of the international landscape and current trends in privacy, and will consider the implications of key case law in New Zealand, discuss New Zealand’s own privacy reforms, and provide practical advice aimed at assisting you in developing and reviewing effective privacy compliance procedures.

Introduction

We live in a world where data is often an organisation’s greatest and most valuable asset. The concept of “personal information” as “data” has transformed over the past decade from essential information that is necessary to receive services or participate in a transaction, to a commodity that is traded freely on a global scale 24 hours a day. With the combination of increased consumer awareness and rapidly changing technology, organisations are required to deal with complex security, privacy and legal implications.

This paper will provide an overview of the national and international privacy landscape as it currently stands, including the proposed privacy reforms in New Zealand and impact of the General Data Protection Regulation (GDPR) in Europe. It will also look more broadly at current trends in privacy, including implications and penalties where data privacy has been breached.
