Introduction

In a world where technology takes centre stage, we experience data breaches on a seemingly regular basis, and artificial intelligence technologies are rapidly evolving, it is imperative that we all understand our responsibilities to protect information under privacy law and continue to assess and appropriately manage cyber security risks. Following the introduction of New Zealand’s new Privacy Act in 2020, we have seen a significant increase in the volume and complexity of privacy related legal work which demonstrates an increased awareness by organisations of the importance of protecting personal information and an acknowledgement of the potential serious consequences of non-compliance.

This paper will provide a general overview of the key principles of the Privacy Act 2020 and a summary of the key themes and trends identified by the Office of the Privacy Commissioner in their annual report of the mandatory data breach reporting regime. We’ll also explore some of the most recent and interesting developments in the privacy law space, both here in New Zealand and overseas.
